SEELS Regional Scientific Conference: Legal Status and Protection of Internationally Displaced Persons, Refugees, Asylum Seekers and Legally Invisible Persons

The Regional Scientific Conference Legal Status and Protection of Internationally Displaced Persons, Refugees, Asylum Seekers and Legally Invisible Persons was held at the Faculty of Law, University of Niš, on 28th May 2021. The Conference marks the completion of the SEELS Forced Migrations Project, which has been carried out within the SEELS Network in cooperation with partner Law Faculties in Skopje, Zenica and Osijek.

In the Conference opening ceremony, the participants were welcomed by Prof. Goran Obradović, Dean of the Law Faculty in Niš. The introductory speech was given by Mr. Vladimir Cucić, the Commissioner for Refugees and Migration of the Republic of Serbia. The Conference proceedings were organizeded in separate panel session, including:
1) Session 1: Labour Law and Social Security
2) Session 2: Human Rights and Anti-Discrimination Law (Subtopics: Civil Procedure Law and Criminal Procedure Law)
3) Session 3: Human Rights and Anti-Discrimination Law (Subtopics - International Public Law, EU Law and Administrative Law)
4) Session 4: Private International Law

In panel sessions, the Conference participants presented national reports on the legal status of internationally displaced persons, refugees, asylum seekers and legally invisible persons in their country of origin: Serbia, Northern Macedonia, Croatia, and Bosnia and Herzegovina. The reports were followed by panel discussions on the presented reports. The submitted national reports will be published in the Guide to Good Practices and thus made accessible to the interested scientific and professional public.

We wish to thank all Conference participants for their valuable contribution to the Conference events.

In particular, we extend our genuine appreciation to external experts, Mr. J.H.A van Loon, the former Secretary General of the Hague Conference on Private International Law (member of GEDIP and the TEE), Professor Fabienne Jault-Seseke, Faculté de droit et de science politique de l’Université de Versailles Saint-Quentin-en-Yvelines (member of GEDIP and the TEE) and Professor Sabine Corneloup, Université Paris II Panthéon-Assas (member of the TEE). The external experts have analyzed the national reports prepared in the field of Private International Law (Session 4).

We look forward to future cooperation with Law Schools within the SEELS Network.

Exchange seminars:

In 2020 and 2021, the exchange seminars will be organized in Serbia, Croatia, North Macedonia and Bosnia and Herzegovina. The seminars are aimed at two target groups. The first one compromises a wide range of stakeholders: individuals employed in the State institutions (e.g. social welfare centers, ministries, police departments, and judges), local government and other public institutions, as well as in the NGO sector. Another target group are MA and PhD law students enrolled at the participating Law Faculties.

Regional Scientific Conference:

SEELS Regional Scientific Conference: Legal Status and Protection of Internationally Displaced Persons, Refugees, Asylum Seekers and Legally Invisible Persons

As the outcome of the exchanging seminars, the legal experts involved will prepare the national reports on the selected topics. Besides, the external experts will provide the reports on the EU standards in the subject matter. All these reports will be presented and discussed at the Regional Scientific Conference.

Guide to Good Practices:

As the final result of the exchange seminars and the Regional Scientific Conference, a Joint Guide to Good Practices will be published and distributed to all relevant institutions. Hence, the final Project beneficiaries would be all employees in the public services and NGOs dealing with the legal protection of the migrants in general. In terms of A Guide to Good Practices, the final beneficiaries could be the broad range of scholars, especially the academics whose field of expertise is related to the legal protection on the migrants.

PROJECT TEAMS

The Forced Migrations Project gathers four project teams stemming from the four law faculties in Serbia (University of Niš), Croatia (University Josip Juraj Strossmayer in Osijek), North Macedonia (University Ss. Cyril and Methodius in Skopje) and Bosnia and Herzegovina (University of Zenica).

The project teams will organize the exchange seminars and prepare the national reports on what was jointly understood as the crucial topics regarding the legal protection of the forced migrants. In that respect, every exchange seminar and national report (Serbian/Croatian/Macedonian/Bosnian) covers three common major topics facilitating comparative analysis:

Labor Law and Social Security (1);
Human Rights and Protection Against Discrimination (2); and
Private International Law (3).

Further on, every major topic covers mandatory subtopics. The list of the project teams and the topics of the exchange seminars/national reports are available in Serbian and English.

The national reports will be published by the end of July 2021 in the joint Guide to Good Practices aimed to the all interested stakeholders and academics in the region.
